Contract / Cancellation Conditions
Legal validity
The present contract only comes into force when the rental agreement signed by both parties is in the landlord’s possession or when the agreed payment has been received by the landlord.
Handover
The rented property is to be handed over to the renter in a clean condition and in a condition suitable for contractual use. If there are defects upon handover or if the inventory is incomplete, the tenant must report this on the same day. Otherwise, the rental property is deemed to have been handed over in perfect condition.
Usage of the Apartment
The rental property is to be used carefully. The tenant is obliged to comply with the house rules and to show consideration for other residents and neighbors. Only as many people may use the rental property as agreed in the contract. Each additional person must be reported to the landlord immediately (settlement of the visitor’s tax).
Extra Costs
The ancillary costs (defective items, etc.) will be settled at the end of the rental period. They are to be paid by the tenant before departure.
Return
At the end of the rental period, the rental property must be left in a tidy condition and with the complete inventory. The tenant is liable for damages to the rental property and for missing inventory. The tenant is obliged to report any damage to the landlord before departure.
Terms of Payment
- CHF 500.00 on booking
- 60% of the total amount up to 3 months before the start of the rental
- Final payment no later than 1 month before the start of the rental period
Cancellation Conditions
If the tenant cancels his/her vacation, he/she remains obliged to pay the agreed rent to the following extent:
- if you cancel the booking within 7 days, you will receive the CHF 500.00 back in full, but this expires on the 8th day!
- 60% of the total amount payable 3 months before the start of the rental period, forfeited if canceled after that
- The remaining payment 1 month before the start of the rental period will be forfeited if the contract is canceled afterwards
If the rented property can be rented otherwise for the same price for the canceled period, the renter is released from paying the rent. In this case he/she owes a fee of CHF 300.00 for expenses incurred (deduction from the reimbursement if payment has already been made, by means of subsequent invoicing if no payment has yet been made). In the event of early departure or late arrival, the tenant remains obliged to pay the rent in full.
Liability
If several tenants have signed the contract, they are jointly and severally liable for all liabilities arising from this contract.
Place of Jurisdiction
For any disputes arising from this tenancy, Swiss law applies and the place of jurisdiction is 6340 Baar.
